Judges Demand

£24,580.00 Paid following Charging Order

Published On: 23rd January 2017

We can report that we have successfully recovered £24,580.00 from a Private Individual on behalf of our Client, an Estate Management Company.

We made direct contact with the debtor and supplied them with full evidence of the claim and outlined our Clients intentions to pursue this matter further if necessary.

As no response was received, we were instructed to proceed with County Court Proceeding, with a view to obtain a Charging Order against his property.

The debtor responded to the claim with an offer of repayment, which would have taken 14 years to repay the debt at the rate offered.

This was rejected by our Client with multiple reasons for rejection such as substantial assets owned the debtor, substantial monthly income and the time it would take to repay the debt at this rate.

The court made a Variation Order to repay the debt at a rate of £2,000.00 per month however, the debtor defaulted on this agreement and we were instructed by our Client to obtain a Charge against the debtors main property (House barn).

We were successful in obtaining a charge against the debtors property.

We have today received full payment following the sale of the property, just 3 months after the charge was granted.
