New Pre Action Protocol Works for Judges Demand

We have recently received a lot of telephone calls and emails from our existing Clients and potential new Clients regarding the pre action protocol amendments from 1st October 2017.

A lot of you seem to be worried that the debtors are now being allowed extended time (30 days) to avoid payment before any action can be taken.

We have tried to look at the positives of this and how it can benefit us and our Clients and we have already started to see the benefits in that the new letters are so in depth that it really helps the debtor to understand the position and provides our Client with the reassurance that the claim is fully detailed to the debtor. Therefore, if the debtor does not respond to the new 30 day letter then this can be referred to within the legal proceedings that can be used to easily overcome any spurious disputes raised at that time.

Aside from this we have also seen an increase in the level of responses received from debtors and payments being made as a result of the 30 day letter and response pack being sent.
