Debtor telling porkies….. £6,000.00 Paid

We recently made contact with a sole trader on behalf of our Client, an Engineering Consulting Company regarding an outstanding balance over £6,000.00.

The debtor claimed to have no funds or assets available to make any payment towards the balance and refused to enter in to any payment plan or negotiations.

We carried out some investigations and found that this was not entirely true, we were instructed to proceed with County Court Proceedings with a view to enforce the Judgment via HCEO if the debtor failed to respond.

County Court Proceedings were issued against the debtor, the debtor failed to respond to the claim form which resulted in a County Court Judgment (CCJ) being awarded in our Clients favour.

We instructed our High Court Enforcement Officers (HCEO) to attend the debtors property. Upon attendance a Vehicle (Nissan Juke) was parked at the side of the property.

No response was received from the debtor after knocking several times however, upon further investigation the HCEO found access through an unlocked door at the rear of the property and finally they were able to meet with the debtor.

The debtor again said he did not have funds or assets however, a check on the vehicle confirmed it was owned by the debtor.

The debtor had to pay the balance or face having his vehicle seized to pay the balance.

The debtor agreed the best option was to pay, so he made payment by debit card.

Our Client is very happy with this outcome and this goes to show that some debtors may ‘tell you porkies’ to put you off pursuing a debt.
